Limited Warranty
These Marco instruments are warranted by Marco Healthcare against defective materials and workmanship under normal use for a period of one year from the date of original purchaser invoice. (An authorized distributor is not an original purchaser.) The exceptions from this standard one year limited warranty are the Marco Slit Lamps (all models) which are provided with an extended three year limited warranty and the Marco RT–700 refractor which carries a five year limited warranty. The special three and five year warranties have exceptions to limits of warranty (see exceptions.) Marco has the option to repair or replace any defective instrument under this warranty.
Exceptions for special three and five year extended warranties: Marco or the Distributor will repair the unit at no charge during the first year of warranty (standard warranty.) For the remaining years of extended warranty coverage (2-3 for Slit Lamps or 2-5 for RT–700), Marco will replace defective parts at no charge and one way FedEx ground freight charges; customer is responsible for labor costs. All other terms of the limited warranty hereby apply.
This warranty applies only to new instruments and does not apply to instruments which have been tampered with or altered in any way, or misused or damaged by accident, normal wear, carelessness or negligence, or installed, or operated in an improper manner, or serviced, or repaired by anyone other than by Marco or an authorized Marco Distributor. Expendable parts, such as lamps, are not warranted hereby.
All claims under this warranty must be in writing directed to Marco or the authorized distributor making the original sale and must be accompanied by a copy of the original invoice.
The company will not be liable for any expense or loss arising from the use of these instruments in the manufacture, sale, handling, repair or replacement of any products, or from the use or inability to use these instruments for any purpose, nor will it be liable for any consequential damages relating thereto.
Purchaser accepts the terms of this warranty, and agrees that this warranty is in lieu of all other warranties, expressed or implied, and all implied warranties of merchantability or fitness for a particular purpose which exceed the above obligations hereby are disclaimed and excluded, and no representative is authorized or allowed to make any obligation for the Company not in accordance with this warranty.
